Nine months after, Family threatens Court action over missing Ogun State Policeman
Nine months after he was declared missing, the family of Police Constable, Emmanuel Gene of the Ogun State Police Command, Ijebu-Igbo division, has threatened to drag the Nigeria Police Force before an industrial court.
In a petition signed by its counsel, Kehinde Bamiwola Esq and addressed to the Chairman, Police Service Commission, the Inspector-General of Police, and the Ogun State Commissioner of Police, the Gene family demanded that Emmanuel be rescued dead or alive or be declared in operation.
Our Source recalls that Emmanuel was alleged to have been kidnapped by hoodlums during an operation in Aba Tuntun in December 2020.
Almost one year after, there has been no news of his whereabouts, his wife, who recently gave birth to his baby, reportedly wallows in tears day and night.
In the petition dated September 21, the family called on the police authorities to intervene by raising questions on the disappearance of the missing cop.
They requested that the Ogun State Commissioner of Police, the Area Commander of Ijebu-Ode, AC Abiodun Onuoha, and the D.P.O., SP Kazeem Solatan should provide answers to the questions.
Bamiwola’s petition reads: “We are Solicitors to the Family of Police Constable Emmanuel Gene (PCF No. 516170); the Family being represented by his wife Mrs. Comfort Gene and Father, Honourable Gene, all of Gene Family, Tube in Ipokia Local Government of Ogun State, herein referred to as our Clients. We have the retainers and authority of the family to petition your good office on the disappearance of the husband and Son of our Clients respectively.
“It is the brief of Our Clients that, sometimes around 1st to 3rd of December, 2020, the Divisional Police Officer (D.P.O.) at Ijebu-Igbo, S.P Kazeem Solatan, upon the request of one Chief Abiodun Bello, the Baale of Aba-Titun at Ijebu-Igbo Area, mobilized his men (Men and officers of the Nigeria Police Force) including PC Emmanuel Gene on the alleged grounds of preventing trespass to Land.
“Trespass to Land is not within the jurisdictional powers of the Nigeria Police, unless the Police are on a mission of enforcing a valid judgment of a Court of competent jurisdiction, on the order presented by the Sheriff of the Court and in Compliance with the provisions of the Sheriff and Civil Process Act, Laws of the Federation, 2004.
“Sir, In one of the previous petitions written by Oluwaseyi Awodele Esq to the Commissioner of Police, Ogun State, it was alleged that the Baale of Aba-Titun sought the assistance of the Divisional Police Officer of Ijebu-Igbo to carry out land-grabbing activities contrary to the Anti-Land Grabbing and Forcible Entry of Land Law of Ogun State, 2016.
“The men of the Nigeria Police Force on the alleged illegal duty were reported to have been attacked by land speculators, miscreants, thugs, and angry dwellers that were probably fed up with the terrorizing and menacing posture of the Baale and his Supporters. It was allegedly reported that many Police Officers sustained injuries as a result of dangerous weapons used in chasing the police officers away. It was later discovered that PC Emmanuel Gene did not return with the officers and has not returned to date.
“It is disheartening that the facts leading to the illegal operation that led to the disappearance of PC Emmanuel Gene have been kept in the dark. The Divisional Police Officer has not opened up on whether PC Emmanuel Gene is dead or alive. This is the most confusing and traumatic aspect of the entire issue since December 2020. S.P Kazeem (the D.P.O.) later claimed before the Commissioner of Police, Ogun State that PC Emmanuel was kidnapped by land grabbers in Aba-Titun.
However, it defies logic to hear that, his Phone, Bag, and Service Gun has been recovered ever since. This discovery vitiated the theory that he was kidnapped. We ask the question! How did the D.P.O recover the Phone, bag, and gun of the Kidnapped person? We reserve our answer to this question as it appears that, the D.P.O is not ready to reveal the true position of the outcome of his illegal and ill-motivated operation.
“Sir, it is almost a year now and nothing has been done to rescue PC Emmanuel Gene if truly he has been kidnapped at Aba-Titun in Ijebu-Igbo. The life of a young man with a future cannot be mortgaged for someone’s inadequacies and operational fallacy. The authority of the Nigeria Police should do the needful or declare him dead, however, not without complying with the Evidence Act on the presumption of death.
“We hereby call on the authority of the Nigeria Police to intervene by raising questions on the disappearance of PC Emmanuel Gene. The Commissioner of Police, Ogun State, the Area Commander of Ijebu-Ode, AC Abiodun Onuoha, and the D.P.O., SP Kazeem Solatan should provide answers to the questions. We are after rescuing the missing PC Emmanuel Gene.
“We await your quick response and actions towards rescuing the PC Emmanuel Gene.”
Speaking with Our Source on Monday, Bamiwola emphasized that his clients would seek redress in court if the police fails to rescue Emmanuel.
“We will seek redress under the duty of care principles at the Industrial Court and demand compensation.
“However, the ultimate thing is to let the family know his whereabouts. The Police can’t claim he had been kidnapped without rescuing him,” Bamiwola posited.
